National Innovation Visa (NIV) (subclass 858) Implemented

On 6 December 2024, the Department of Home Affairs implemented the National Innovation (subclass 858) visa.

This new visa program, which has replaced the existing Global Talent Visa (Subclass 858), has been designed to attract world-class talent across various fields, from cutting-edge researchers to established and emerging entrepreneurs, professional athletes and the talented individuals in the arts.

Key Features of the National Innovation Visa

The National Innovation Visa (NIV) maintains the subclass 858 designation but introduces several significant changes:

Targeted Talent Categories:

The visa has been targeted to the following four main categories:

  • Global Researchers

Applicants will be required to demonstrate a high-calibre research background, including notable publications in highly regarded journals, high citation counts, and evidence of awards and/or recognition that highlights their leadership in their field.

  • Entrepreneurs

Successful established or emerging entrepreneurs in fields that are being targeted by the Australian government with innovative products and services.

  • Innovative Investors

Investors with a record of investing in innovative and industry leading sectors that can contribute to the Australian economy.

  • Athletes and Creatives

High performing, top-tier athletes and creatives that can contribute to Australia’s sporting and creative sectors.

Each category has specific criteria that emphasise exceptional achievements and potential contributions to Australia’s innovation ecosystem.

Changes from the Global Talent Visa

The National Innovation Visa has the following differences from the previous Global Talent Visa:

  • Rebranding: The visa class has been renamed from the Global Talent Visa to the National Innovation Visa however keeps the same subclass 858.
  • Invitation-based system: Applications are now by invitation only. Direct applications cannot be made without receiving an invitation first.
  • Achievement/skills alignment: Applicants must demonstrate achievements consistent with their invitation letter.
  • Streamlined process: The Expression of Interest (EOI) can be lodged directly, and if an invitation is received, the applicant can proceed to submit their application via ImmiAccount. The role of the Prime Minister’s Special Envoy for Global Business and Talent Attraction has also been closed.

Benefits of the National Innovation (NIV) (subclass 858) visa

The National Innovation (subclass 858) visa offers the following benefits:

  • Permanent residency. Once granted, the applicant (and any dependent family members) become Australian permanent residents and have a pathway to Australian citizenship
  • No age restrictions
  • Flexible English proficiency requirements
  • Freedom to work in any occupation

Transitional Arrangements

Applications submitted before December 6, 2024, will be assessed under the previous Global Talent Visa criteria. The new regulations apply only to applications lodged on or after the implementation date.
