TSS (subclass 482) visa holders eligible for permanent residency clarification
The Department of Home Affairs has today provided clarification on the recent announcement that pathways will be available for TSS SC482 visa holders.
The Department has confirmed that by the end of 2023, the Temporary Residence Transition (TRT) stream of the Employer Nominated (subclass 186) will be amended and allow all TSS (subclass 482) visa holders to apply for permanent residency via the Employer Nominated Scheme (subclass 186) visa in the TRT stream.
The information provided so far by the Department has confirmed the following:
- Applicants will need to continue to work in their occupations that have been nominated for their TSS visa(s)
- Sponsored visa holders will be eligible for ENS TRT after two years (instead of the three years) of sponsorship on a TSS by their employer
- Applicants will need to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme visa (such as the age criteria)
- The limit on short-term stream TSS visa applications that can be made onshore, in Australia has also been removed to allow applicants and current visa holders to complete two years with their employer without having to depart Australia
